April 2018 – Emiliano Zapata (47) pleaded guilty to one count of animal cruelty (Agriculture and Markets Law § 353). In full satisfaction of the charges he was sentenced to time served.  In a superseding information, defendant was charged with 17 counts of animal cruelty (Agriculture and Markets Law § 353) and 10 counts of improper disposal of dead animals (Agriculture and Markets Law § 377).

October 2015 – Zapata faced multiple charges of animal abuse and neglect and unlawful disposal of animals after his arrest.. Hudson Valley SPCA’s Humane Law Enforcement Division, state police and animal rescue groups removed more than 100 animals from a 300-acre farm he was renting  including cattle, chickens, sheep, goats and pigs.

Aggravated cruelty to animals—as defined in Section 353-a of the Agriculture and Markets Law—is not a bail-eligible offense. Individuals charged with this felony are generally released without bail, regardless of the severity of the alleged act.
